This matter came before the Washington State Public Disclosure Commission on May 23, 2019, at the PDC office, Room 206, Evergreen Plaza Building, 711 Capitol Way, Olympia, Washington. Respondent Carla Marconi requested reconsideration of the Commission's Order issued on November 20, 2018, following a Brief Enforcement Hearing (brief adjudicative proceeding) in this matter. The hearing was held in accordance with Chapters 34.05 and 42.17A RCW and Chapter 390-37 WAC.
Commissioners present were Anne Levinson, Commission Chair (presiding); David Ammons, Commission Vice-Chair; and Commissioners William Downing, Russell Lehman, and Fred Jarrett. Also present were Assistant Attorney General John S. Meader representing the Commission, Assistant Attorney General Chad Standifer representing PDC Staff, and Alice Fiman, Compliance Officer. Respondent Carla Marconi participated by telephone. The proceeding was open to the public and recorded.
Conclusions of Law
The Commission has jurisdiction over this proceeding pursuant to Chapter 42.17A RCW, State campaign finance and disclosure law; Chapter 34.05 RCW, the Administrative procedure Act; and Title 390 WAC. The Respondent violated RCW 42.17A.700 by failing to timely file a Personal Financial Affairs Statement (F-1 report), due no later than April 16, 2018, certifying financial activity for calendar year 2017.
Order
The Respondent's request for reconsideration is granted. This Amended Order will be the Final Order. The Findings of Fact and Conclusions of Law entered on October 25, 2018, are affirmed. Of the $500 penalty assessed in the November 20, 2018, Order, $400 is suspended on the following conditions:
1. Respondent Carla Marconi pays the non-suspended portion of the penalty ($100) in two $50 installments, the first being due on June 30, 2019 and the second on July 31, 2019; 2. The Respondent files the missing F-1 reports for 2018, certifying financial activity for calendar year 2017, and for 2017, certifying financial activity for calendar year 2016, by May 31, 2019; 3. The Respondent is in compliance with all PDC reporting requirements and commits no further violations of Chapter 42.17A. RCW or Title 390 WAC for a period of four years from the date of this Order.
If the Respondent fails to comply with any of the conditions of this Order, the suspended portion of the penalty ($400) shall immediately become due without further action by the Commission.
